1. Who We Are
CuranetMD LLC ("CuranetMD", "we", "us"), 18001 Sky Park Circle, Ste K, Irvine, CA 92614, operates curanetmd.com and provides revenue cycle, credentialing and administrative support services to medical practices and billing companies in the United States.
2. Acceptance of These Terms
By using this website you agree to these terms. If you engage us for services, you also agree to them by signing a services agreement or scope with us. Where a signed agreement, scope or business associate agreement says something different from these terms, the signed document controls for that engagement. If you place an order on this site, you also agree to these terms by checking the box before you pay.
3. Use of This Website
You may use this website to learn about our services, contact us, book a call and apply for roles. You agree not to:
- use the site for anything unlawful or misleading;
- try to gain unauthorized access to the site or the systems behind it, or disrupt them;
- copy, scrape or reuse the site's content except as the law allows;
- send patient information or anyone else's personal information without the right to do so.
Information you send us through the site should be accurate and yours to share.
4. SMS Messaging Terms
CuranetMD sends text messages to people who request contact through this website and who check the SMS consent box on our contact form. Consent is not a condition of purchase.
- Message types: replies to your inquiry and information about the services you asked about. We do not send marketing or promotional text messages.
- Message frequency varies.
- Message and data rates may apply.
- Reply STOP, CANCEL, END, UNSUBSCRIBE or QUIT to opt out at any time. You will receive one confirmation message and no further messages after that. Reply START to subscribe again.
- Reply HELP for help, or contact support@curanetmd.com.
- If you change or give up your mobile number, reply STOP from it first or tell us so we can remove it.
- You must be 18 or older to receive text messages from us.
- Carriers are not liable for delayed or undelivered messages.
5. Services and Engagements
We provide services under a written scope for each service. The scope sets out what we will do, the systems we will work in, the reporting you will receive, the named lead for your account and the fees. A scope takes effect when both parties sign it, and it changes only by a written change both parties approve. Work outside a scope is not included until it is added this way. During an engagement and for the period set out in the agreement, neither party will solicit the other's staff who worked on the engagement. Where we work for a billing company as its subcontractor, we will not solicit or contact that company's clients, during the engagement and for the period set out in the agreement, except as the billing company asks.
6. Fees and Payment
Fees, billing frequency and payment terms are stated in each scope. Invoices are payable as the scope sets out. If an invoice is not paid on time, we may charge late fees where the scope allows and, after written notice, pause work until the account is current. Fees do not include taxes, which are the client's responsibility except for taxes on our income.
Online Orders
This part applies to credentialing services ordered and paid for on this site. Where it differs from sections 5, 6 and 13, this part controls for online orders.
Your order. Your order is your scope. It covers the services and quantities you choose on the order page, as shown in your order summary and in the confirmation email we send after payment. Work not in your order can be added by a new order or a signed scope.
Payment. You pay in full when you order, by card on Stripe's secure payment page. Prices are in US dollars. Stripe processes the payment; we never see or store your card details.
Refunds. All payments are final. We do not give refunds once payment has been made, even if the order is cancelled.
What we need from you. After payment our credentialing team emails you to collect the documents and information your order needs. Work starts once we have a complete document set. Our only timing commitment is one business day from a complete document set to filing, excluding weekends and US federal holidays. Payer decisions, payer processing times and outcomes are outside our control and are not guaranteed.
Monthly Plan. If you add the Monthly Plan, it renews automatically every month at the price shown in your order, charged to the card you paid with, until you cancel. You can cancel anytime online with Manage or Cancel Your Plan, linked on our order pages and in your confirmation email, or by email to support@curanetmd.com. Cancellation takes effect at the end of the month already paid and the plan stops then, with no partial refunds. We confirm every cancellation by email. If a monthly payment fails, Stripe will try the card again; if it still cannot be collected, the plan stops. If the plan price changes, we will email you at least 30 days before the new price applies, and you can cancel before then.
Ending an order. If you cancel an order, we stop work on it. The refund rule above still applies.
7. Client Responsibilities
To let us do the work, the client will:
- give our team access to the systems named in the scope, set up by the client with only the permissions the work needs, and remove that access when the engagement ends;
- provide documentation, information and decisions on time;
- make sure the information it supplies, including provider and payer details, is accurate and complete;
- name a contact who can answer questions and approve work.
Delays caused by missing access or information may move the dates in a scope.
8. Confidentiality and Protected Health Information
Each party will keep the other's confidential information private, use it only for the engagement and share it only with people who need it and are bound to protect it. These duties do not cover information that is public, already known to the receiving party or that must be disclosed by law. Protected health information we handle for a client is governed by our business associate agreement with that client and by HIPAA. We sign a business associate agreement before any work that involves protected health information.
9. Intellectual Property
We own this website and its content, including text, graphics and the CuranetMD name and logo; you may not use them without our written permission. Clients own their data and their patients' records. We own our methods, templates and internal tools, including any improvements to them. Work product delivered under a scope may be used by the client for its own business once the related fees are paid.
10. Disclaimers
The content on this website is general information. It is not legal, financial, tax or clinical advice. Payer decisions, payer processing times and reimbursement amounts are outside our control, so no particular outcome, approval or collection result can be promised. Except as stated in a signed agreement, the website and its content are provided "as is", without warranties of any kind to the extent the law allows.
11. Limitation of Liability
To the extent the law allows, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or revenue, arising from the website or an engagement. Our total liability for any engagement is limited to the fees the client paid us under that engagement in the 12 months before the claim arose. These limits do not apply to a party's fraud, willful misconduct or obligations that the law does not allow to be limited.
12. Indemnification
Each party will defend and indemnify the other against third-party claims caused by its breach of a signed agreement, its negligence or willful misconduct, or its violation of law. The party seeking indemnity must notify the other promptly, let it control the defense and cooperate reasonably. A signed agreement may set out further detail.
13. Term and Termination
Each engagement runs for the term stated in its scope. Either party may end an engagement by giving the notice the scope sets out, or immediately by written notice if the other party materially breaches the agreement and does not fix it within the cure period the agreement allows. When an engagement ends, the client pays for work done up to the end date, we hand over open work and records as the scope describes, and the client removes our system access.
14. Governing Law and Disputes
These terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. The parties will first try to resolve any dispute in good faith through their named contacts. If that does not work, the dispute will be decided by the state or federal courts located in Orange County, California, and both parties agree to their jurisdiction.
15. Changes to These Terms
We may update these terms from time to time. When we do, we will post the new version on this page and change the Last Updated date at the top. If you continue to use the site after a change, the updated terms apply. Changes do not alter a signed agreement unless both parties agree in writing.
16. Contact Us
Questions about these terms can be sent to CuranetMD LLC, 18001 Sky Park Circle, Ste K, Irvine, CA 92614, or by email to support@curanetmd.com.
